Terms of Use

These Terms of Use, including our Privacy Policy, Cookies Policy, Data Processing Addendum, and Terms of Third-Party Integration (collectively, “Terms”), establish the terms and conditions governing your use of services provided by My Lekha Tech Solutions. By clicking “Accept” or using any of the Services, you acknowledge that you have read, understood, and agreed to these Terms on behalf of yourself or any entity you represent. If you do not agree to any of these Terms, you should not use the Services. All rights not expressly granted in these Terms are reserved by My Lekha Tech Solutions.

We may update these Terms periodically by posting revisions on our website. You are responsible for reviewing these Terms regularly. If you do not accept any changes, you must cease using the Services. These Terms of Use were last updated on 03/09/2025.

1. Definitions

To assist you in understanding these Terms, we have defined key terms below:

  • “Customer” refers to any individual or entity that registers to use the Services by creating a My Lekha account. If you are creating an account on behalf of a business, you confirm that you have the authority to accept these Terms on behalf of that business, which will be bound by these Terms.
  • “Authorized User” refers to any person or entity authorized by a Customer to use the Services. This includes employees, personnel, support partners, and third parties with whom the Customer shares account details and for whom the Customer is responsible.
  • “Personal Data” means any data related to an identifiable natural person, such as name, identification number, location data, online identifiers, financial details, or any other information that can be used to identify an individual.
  • “Sensitive Data” includes data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, health data, sexual orientation, genetic or biometric data, or criminal records.
  • “We,” “Us,” or “My Lekha” refers to My Lekha Tech Solutions.
  • “Services” refer to My Lekha‘s point-of-sale and inventory management products, including MyLekha Dashboard (App), MyLekha POS (App), mylekha.net (Website).
  • “Content” includes text, graphics, audio, video materials, and documentation available through the Services.
  • “You” refers to the Customer and, where applicable, any Authorized Users.

2. Account Information

To use our Services, you must be at least the minimum legal age in your country to enter into a binding contract. You agree to provide accurate and up-to-date information and to promptly update any changes. We will use this information to contact you, so maintaining accurate contact details is your responsibility.

3. Use of Your Account

My Lekha Tech Solutions grants you a limited, non-exclusive, non-transferable, revocable license to use the Services solely for your business operations. You are responsible for any activity that occurs under your account and for maintaining security over your login credentials.

If you authorize users under your account, you are responsible for managing their access and ensuring they comply with these Terms. You indemnify My Lekha Tech Solutions against any claims or losses resulting from your Authorized Users’ actions.

In case of disputes between a Customer and an Authorized User regarding account access, the Customer has the final authority to determine access rights.

4. Cancellation and Account Suspension

We may cancel or suspend your account under the following conditions:

  • Violation of these Terms or any applicable laws.
  • If continued provision of Services in your region is likely to breach legal requirements.
  • If your use of the Services poses a security or availability risk to our systems or other customers.

You may cancel your account at any time by sending an email to [email protected]. Upon cancellation, your access to Services will be revoked, and you will not be eligible for a refund of any pre-paid fees. Data will be retained for 30 days before being permanently deleted unless legally required otherwise.

5. Fees, Payment & Refund Policy

  • MyLekha offers a 45-day free access period for all new users. At the end of the free trial, the subscription will expire, and you will have to pay manually through the available payment for a paid plan that has been introduced.
  • All subscription fees:
    • are billed in advance
    • may be charged monthly, semi-annually, or annually
    • are non-refundable, including for partial periods of use
    • may change with 7 days’ prior notice
  • No charges will be made automatically without your action.
  • A valid payment method is required for all transactions.
    Your bank may apply additional charges, which are outside of MyLekha’s control.
  • Because payments are manual, you will only be charged when:
    • you choose a plan
    • you confirm payment through your selected payment method
    • you renew your next billing period voluntarily
  • MyLekha does not store your card for automatic payments.
    Your subscription will not renew automatically.
  • To continue using paid features:
    • you must manually renew your plan before your billing period ends
    • if payment is not made, your account will automatically revert to the free plan (or lose access to paid features)

6. Cancellation Policy

You may cancel your subscription at any time by:

  • stopping renewal
  • not making the next manual payment

Because payments are manual:

  • no automatic charges will occur
  • no refunds will be provided for periods already paid

You will continue to access paid features until your current paid period expires.

7. Chargebacks & Disputes

If you believe a charge was made in error, please contact MyLekha Support before opening a chargeback.

We aim to resolve billing issues quickly.

Chargebacks filed incorrectly may lead to:

  • temporary account suspension
  • limitations on promotional or free-trial offers

8. Fair and Reasonable Use Policy

We reserve the right to impose limits on excessive usage, including:

  • Storage required for hosting and backup.
  • Sales transaction volume.
  • Page views or bandwidth usage.
  • Number of stores, POS devices, employees, or customers.

We will attempt to notify you 24 hours in advance if your usage needs to be reduced.

9. Data Protection and Privacy

We implement technical and organizational measures to safeguard your data. You are responsible for complying with applicable data protection laws and obtaining necessary consents from end-users whose data you process through our Services.

Sensitive Data should not be processed through our Services.

Upon termination of your account, your data will be deleted after 30 days, unless required by law to be retained longer.

10. Intellectual Property

All intellectual property rights in our Services, including software, content, design, and technology, remain the property of My Lekha Tech Solutions. You may not copy, modify, distribute, or reverse-engineer any part of our Services without prior written consent.

11. Disclaimers and Limitation of Liability

My Lekha Tech Solutions provides the Services on an “as is” and “as available” basis. We do not guarantee that the Services will be uninterrupted, error-free, or meet all your business needs.

We are not liable for any:

  • Indirect, incidental, or consequential damages.
  • Loss of data, business, or profits.
  • Unauthorized access to or use of your account.
  • Transactions made by third parties using your account.

Your sole remedy for dissatisfaction with our Services is to stop using them. Additionally, you agree that any intentional act of spreading misinformation or engaging in activities that harm the reputation of My Lekha Tech Solutions may result in legal penalties, including fines, as determined by applicable laws.

12. Governing Law

These Terms are governed by the laws of Cambodia. Any disputes will be resolved exclusively in the courts of Cambodia.

13. General Provisions

  • Third-Party Services: We may partner with third parties for additional services. We are not responsible for third-party service terms, performance, or obligations.
  • No Waiver: Failure to enforce any provision does not waive our right to enforce it later.
  • Business Use Only: Our Services are intended for business purposes and are not subject to consumer protection laws.
